TikTok is not going down without a fight. Its Chinese parent ByteDance filed a lawsuit against the US government challenging a law that would force a sale or ban of TikTok in the US. The law, which was passed in April, would require ByteDance to sell TikTok by January 19, 2025. The US lawmakers are concerned the Chinese Communist party will use TikTok to spy on its 170 million US users while also spreading propaganda, wielding Chinese influence over the US. This is the first time in history that Congress has singled out a speech platform and enacted a law to bar American’s from participating in the popular online community. TikTok is claiming such a law to ban TikTok or force a sale is a breach of the First Amendment rights to free speech.
After lawmakers received classified briefings raising national security concerns, the law was quickly passed. Republican congressman John Moolenaar, chair of the House Select Committee on the strategic competition between the US and Chinese Communist Party said he was confident the legislation would be upheld, despite the challenge from TikTok. The law was signed by President Joe Biden and inflamed US-China relations. The lawsuit may make its way to the Supreme Court which will decide the fate of TikTok.
